If you’ve recently learned that a legal paraprofessional can help with certain legal matters in Arizona, you might be trying to understand exactly what that means for you. What is a legal paraprofessional in Arizona? The term legal paraprofessional can be confusing, especially when you’re used to thinking of legal help as something that can only come from a lawyer.

What Is an Arizona Legal Paraprofessional?

A legal paraprofessional is a person licensed by the Arizona Supreme Court. Under Arizona Supreme Court Rule 31.3(e)(4), legal paraprofessionals may provide legal services as an exception to Arizona’s general prohibition on the unauthorized practice of law, allowing them to provide certain services without attorney supervision.

That’s an important distinction because most paralegals can’t independently give legal advice, represent clients, or perform other tasks that constitute the practice of law. In 2025, Arizona issued 82 legal paraprofessional licenses, authorizing them to:

  • Give legal advice about specific rights, remedies, defenses, options, or strategies.
  • Prepare, sign, draft, and file certain legal documents.
  • Assist with discovery and other authorized court filings.
  • Appear for clients in certain court proceedings, mediations, arbitrations, and settlement conferences.
  • Negotiate certain legal rights and responsibilities on behalf of a client.
  • Provide services only within the practice area covered by the professional’s license.

That’s also why Arizona legal paraprofessional laws are important to understand before you hire anyone. The rules establish what these professionals can and can’t do, and those limits are there to protect clients. Arizona also maintains a public directory where people can verify whether a legal paraprofessional is currently licensed.

How a Legal Paraprofessional Differs From a Lawyer

A legal paraprofessional and a lawyer can both help with legal matters, but they don’t have the same authority. An Arizona attorney has broader authority to practice law, while a legal paraprofessional has a separate license and can only provide services within the areas and limits of that license.

Under ACJA § 7-210, a legal paraprofessional can provide certain legal services without an attorney supervising them. Depending on the area of practice, this can include giving legal advice, preparing and filing documents, negotiating, and representing a client in certain proceedings.

What Types of Cases Can Legal Paraprofessionals Handle?

Legal paraprofessionals don’t have unlimited authority to take on every type of legal matter. Instead, Arizona divides their permitted work into specific practice areas. That means that the services available to you depend on the license that was issued and any restrictions attached to it. Generally, the program covers areas like:

  • Family law, including certain domestic-relations matters
  • Limited-jurisdiction civil law involving certain cases within courts of limited jurisdiction
  • Criminal law, subject to specific requirements and limitations
  • Administrative law involving matters that fall within the authorized scope
  • Other services specifically permitted under the applicable licensing rules

Before hiring a legal paraprofessional for your case, we recommend taking a minute to identify exactly what kind of legal assistance you need. Then, check the professional’s license and make sure that your matter falls within the scope of that license. It’s a simple step, but it can save you a lot of confusion later.

The Cost of a Legal Paraprofessional

There’s no single answer to the question of legal paraprofessional cost. Just like when it comes to hiring a lawyer, fees can depend on the professional, the type of legal paraprofessional case, how much work is involved, and whether you’re paying for a particular service or ongoing representation. When you’re comparing fees, it’s worth asking:

  • Is the fee hourly or flat-rate?
  • What exactly is included?
  • Are court appearances charged separately?
  • Are filing and service fees separate?
  • What happens if the matter becomes more complicated?
  • Are additional services billed separately?

When you’re evaluating legal paraprofessional costs, it’s important to ask about what you’re actually getting for that fee. A lower hourly rate isn’t necessarily less expensive overall if fewer services are included.

FAQs

Are Legal Paraprofessionals Subject to Professional Discipline in Arizona?

Yes, legal paraprofessionals are subject to professional discipline in Arizona. The Arizona Supreme Court oversees the licensing framework, and licensees must comply with applicable rules that govern their conduct and practice. If a client believes a legal paraprofessional has acted improperly, there are established procedures for addressing professional-conduct concerns. These safeguards help maintain accountability within Arizona’s legal paraprofessional laws.

Do Legal Paraprofessionals Have to Follow Confidentiality Rules?

Yes, legal paraprofessionals have to follow confidentiality rules. Licensed legal paraprofessionals have professional obligations concerning client information and must follow all of the applicable ethical requirements. Confidentiality obligations are an important part of the professional relationship, although the precise protections and circumstances can differ depending on the nature of the communication.

Does Arizona Require Legal Paraprofessionals to Maintain Continuing Education?

Yes, Arizona requires legal professionals to maintain continuing education. These requirements help licensees stay current as Arizona’s laws, court procedures, and professional rules change. Maintaining the required education is part of remaining in good standing so that they can continue to provide authorized legal services under Arizona’s legal paraprofessional laws.

Can a Legal Paraprofessional Speak to the Other Party’s Lawyer?

Under certain circumstances, yes, a legal paraprofessional can speak to the other party’s lawyer when permitted by the scope of their license and the nature of the case. This can help keep discussions about the legal matter organized and focused. Their authority is still limited, though, so they can’t automatically handle every type of communication or negotiation simply because they’re representing a client.
